1. Agreement to Terms

Welcome to Fast Press AI! These Terms of Use ("Terms") govern your access to and use of our website https://www.fastpressai.com, including our AI content generation tools and publishing platform (collectively, the "Service"). The Service is provided by Fast Press AI ("Company," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. User Accounts and Registration

To access most features of the Service, you must register for an account. You can create an account by logging in through your Google account.

By registering, you agree to:

  • Provide accurate, current, and complete information as prompted by the Google Sign-in process.
  • Maintain the security of your account and not share your login credentials with others.
  • Accept full responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

You must be at least 13 years old to use the Service.

3. User-Generated Content

Our Service allows you to create, edit, save, and publish content using our AI tools ("User-Generated Content" or "UGC").

  • Your Ownership and Responsibility: You retain all ownership rights to the User-Generated Content you create. You are solely responsible for your UGC and the consequences of creating, posting, or publishing it. You represent and warrant that you have all necessary rights to your UGC and that it does not infringe upon the intellectual property rights, privacy rights, or any other legal rights of any third party.
  • Our License to Your Content: To operate and provide the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, and display your UGC in connection with the Service. This license is for the limited purpose of:
    • Operating, providing, and improving the Service.
    • Displaying your UGC within your private account dashboard.
    • If you choose to publish your UGC, this license extends to distributing, publicly performing, and publicly displaying your content on our platform.
  • AI-Generated Content: The Service uses artificial intelligence to generate content. The generated content is not guaranteed to be unique, accurate, or free from errors. You are responsible for reviewing and verifying all AI-generated content for accuracy and appropriateness before use or publication. We are not liable for any inaccuracies, errors, or any content that may be deemed offensive or misleading.

4. Acceptable Use Policy

You agree not to use the Service to create, upload, or distribute any content or engage in any activity that:

  • Violates any local, state, national, or international law or regulation.
  • Is unlawful, fraudulent, harmful, threatening, abusive, defamatory, obscene, or hateful.
  • Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Attempts to decompile, reverse engineer, or otherwise attempt to obtain the source code of the Service.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
  • Generates spam or is used to create content for deceptive purposes (e.g., spreading misinformation).

We reserve the right to remove any content and terminate any account that violates these terms, at our sole discretion and without prior notice.

5. Our Intellectual Property

Excluding your User-Generated Content, all aspects of the Service, including the website, text, graphics, logos, icons, software, and the "look and feel" thereof, are the exclusive property of Fast Press AI and are protected by Indian and international copyright, trademark, and other intellectual property laws.

6. Termination

You may terminate these Terms at any time by deleting your account and discontinuing your use of the Service.

We may, in our sole discretion, suspend or terminate your account and access to the Service at any time, for any reason or no reason, including for breach of these Terms, without prior notice or liability to you.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE OR THE AI-GENERATED CONTENT WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAST PRESS AI, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONTENT OBTAINED FROM THE SERVICE, ESPECIALLY AI-GENERATED CONTENT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US, IF ANY, IN THE 6 MONTHS PRECEDING THE CLAIM, OR FIVE THOUSAND INDIAN RUPEES (₹5000 INR).

9. Indemnification

You agree to defend, indemnify, and hold harmless Fast Press AI and its employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your User-Generated Content, or your violation of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the courts located in Ludhiana, Punjab, India, and you hereby consent to the jurisdiction of such courts.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes, we will post the revised Terms on the Service and update the "Effective Date" above. Your continued use of the Service after the revised Terms have become effective indicates that you have read, understood, and agreed to the current version of the Terms.
